SMS & EMAIL MARKETING:

  1. This campaign sends appointment information - confirmation & reminder messages to customers once they have booked an appointment with L-Evate Marketing on website and opted-in to receive promotional and notification SMS from L-Evate Marketing.

  2. You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

  3. If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to info@levatemarketing.com or 619-450-1293.

  4. Carriers are not liable for delayed or undelivered messages.

  5. As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

Digital Services and Marketing Subscription Terms and Conditions

1. Introduction:

  • This agreement outlines the terms and conditions governing Customer's access to and use of Company's digital marketing services ("Services") provided on a subscription basis.

2. Services Description:

  • Company will provide Customer with a range of digital marketing services including Website design, SEO, social media management, email marketing, content creation, based on the selected subscription plan.

3. Subscription and Payment:

  • Subscription Plans: Customer can choose a subscription plan with a set monthly or annual fee, which will automatically renew unless cancelled in accordance with the termination policy.

  • Payment Method: Customer must provide a valid payment method for recurring subscription fees.

  • Late Payments: Unpaid invoices may incur late fees as per Company policy.

4. Access and Usage:

  • Account Access:

    Customer will receive login credentials to access the Company's platform and manage their services.

  • Customer Responsibilities:

    Customer is responsible for providing accurate information, maintaining login security, and notifying Company of any unauthorized access.

5. Intellectual Property:

  • Company Ownership:

    All intellectual property rights related to the Services, including software, content, and branding, remain the exclusive property of the Company.

  • Customer Content:

    Customer retains ownership of content provided to Company for marketing purposes, but grants Company a non-exclusive license to use such content in accordance with the Services.

6. Performance and Deliverables:

  • Reporting:

    Company will provide regular performance reports to Customer detailing key metrics related to the marketing campaign.

  • Reasonable Efforts:

    Company will use commercially reasonable efforts to achieve the agreed upon marketing objectives, but cannot guarantee specific results.

7. Termination:

  • By Customer:

    Customer can cancel their subscription at any time, effective at the end of the current billing cycle.

  • By Company:

    Company may terminate the agreement immediately if Customer breaches these terms, fails to pay fees, or engages in fraudulent activity.

8. Limitation of Liability:

  • No Guarantees:

    Company does not guarantee any specific outcomes or results from the Services.

  • Liability Cap:

    In no event shall Company be liable for any indirect, consequential, or punitive damages arising from the use of Services.

9. Confidentiality:

  • Both parties agree to maintain the confidentiality of all sensitive information disclosed during the course of this agreement.

10. Governing Law:

  • This agreement shall be governed by and construed in accordance with the laws of [Your State].

11. Amendments:

  • Company may modify these Terms and Conditions at any time, with reasonable notice to Customer.
